1. Acceptance of terms
By creating a AfriTrade Pay account or using any AfriTrade Pay service, you agree to be bound by these Terms. If you do not agree, do not use the service. These Terms apply to individuals and to entities acting through authorized representatives.
2. Definitions
"AfriTrade Pay", "we", "us" refers to AfriTrade Pay, Inc. "Service" refers to our wallets, cards, transfers, swap, AI assistant, payments, developer API and any related features. "User", "you" refers to any person or entity using the Service.
3. Eligibility
You must be at least 18 years old and legally able to enter into binding contracts. You must comply with all applicable laws in your jurisdiction. We may verify your identity and refuse service at our discretion.
4. Account security
You are responsible for maintaining the confidentiality of your credentials, biometric factors and devices. You must notify us immediately of any unauthorized access. We are not liable for losses caused by your failure to safeguard your account.
5. Acceptable use
You agree not to use AfriTrade Pay for fraud, money laundering, terrorist financing, sanctions evasion, sale of restricted goods, or any illegal activity. Violations result in immediate suspension and may be reported to authorities.
6. Fees
Personal accounts are free. Some optional services (international transfers, card issuance, crypto trades) carry transparent fees disclosed before each action. Business plans are billed as agreed in your Order Form.
7. Suspension and termination
We may suspend or terminate accounts at our discretion, particularly to comply with law, prevent fraud or protect the platform. You may close your account at any time from Settings; outstanding balances will be returned per our refund policy.
8. Disclaimers and limitation of liability
The Service is provided "as is". To the maximum extent permitted by law, our liability is limited to the fees you paid us in the prior 12 months. We are not liable for indirect, incidental or consequential damages.
9. Disputes and governing law
These Terms are governed by the laws of England and Wales for EU users, and the State of Delaware for US users. Disputes are resolved by binding arbitration except where prohibited by law.
